Please read these Terms of Service ("Terms") carefully before using TacticalVision (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using TacticalVision, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

TacticalVision is a display filter application for Windows that adjusts your monitor's color output system-wide. The App uses Windows system APIs to modify display settings including brightness, contrast, saturation, gamma, and other visual parameters.

3. License Grant

3.1 Free Version

We grant you a limited, non-exclusive, non-transferable, revocable license to use the free features of TacticalVision for personal, non-commercial purposes.

3.2 Premium Version

Upon purchase of premium features through the Microsoft Store, you are granted additional rights to use premium functionality subject to the terms of your purchase. Premium licenses are:

• Non-transferable
• For personal use only unless otherwise specified
• Subject to Microsoft Store terms and refund policies

4. Acceptable Use

You agree to use TacticalVision only for lawful purposes. You shall not:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on the App
• Redistribute, sell, lease, or sublicense the App
• Remove or alter any proprietary notices or labels
• Use the App in any way that violates applicable laws or regulations
• Use the App to gain unfair advantages in games where display modifications are explicitly prohibited by the game's terms of service

5. Game Compatibility and Fair Play

5.1 How the App Works

TacticalVision adjusts your display output at the operating system level, similar to your monitor's built-in settings. It does not:

• Inject code into games or other applications
• Modify game files or memory
• Interact with anti-cheat systems
• Provide automated gameplay advantages (aimbots, wallhacks, etc.)

5.2 User Responsibility

While TacticalVision functions similarly to monitor settings adjustments, you are responsible for ensuring your use complies with the terms of service of any games you play. We make no representations about whether specific games permit the use of display modification software.

5.3 No Guarantee

We do not guarantee that use of TacticalVision will not result in penalties from game publishers or anti-cheat systems, although the App is designed to operate at the system level without interacting with games directly.

6. Intellectual Property

TacticalVision and all related content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. The App is licensed, not sold, to you.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• The App will be compatible with all hardware configurations or games

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

• Loss of profits, data, or goodwill
• Game account suspensions or bans
• Hardware malfunctions
• Any other intangible losses

Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless TacticalVision and its developers from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

10. Updates and Modifications

We may update, modify, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes to the Terms constitutes acceptance of those changes.

11. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for any reason, including breach of these Terms. Upon termination:

• Your license to use the App is revoked
• You must uninstall and destroy all copies of the App
• Sections of these Terms that by their nature should survive will survive termination

12. Third-Party Services

The App is distributed through the Microsoft Store. Your use of the Microsoft Store is subject to Microsoft's terms and conditions. We are not responsible for Microsoft Store's availability, policies, or practices.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TacticalVision regarding the App and supersede all prior agreements.
